Service Description: This data layer depicts the DOS identified artificial canals where the DOS has concurred with issuance of Nationwide Permit 3 (Maintenance), 13 (Bank Stabilization) and 45 (Repair of Uplands Damaged by Discrete Events) which would affect New York's Coastal area. It is intended to aid the United States Army Corps of Engineers in administering the Nationwide Permit Program and permit applicants in determining if a consistency certification is required for a proposed activity pursuant to 15 CFR Part 930.

Description: Federal consistency provisions of the Coastal Zone Management Act require that all Federal agency activities affecting any coastal use or resource will be undertaken in a manner consistent to the maximum extent practible with the enforceable policies of approved coastal management programs. The Department of State (DOS) reviewed the reissuance and modification of the Army Corps of Engineers nationwide permits and the issuance of 2 new nationwide permits for consistency with the New York State Coastal Management Program pursuant to 15 CFR Part 930.41. The DOS concurred with nationwide permit numbers 3 (Maintenance), 13 (Bank Stabilization), and 45 (Repair of Uplands Damaged by Discrete Events) which complied with all Buffalo and New York District regional conditions where the proposed activity was within a DOS identified articifical canal. Artificial canals were identified through "heads-up digitizing" using desktop GIS software and orthro corrected photography at a scale of 1:5000. The point was placed at the geographic center of the canal. The Waterbody name field was populated first through a spatial join with the 2016 ALIS Hydrography dataset and then with ESRI's World Street Map.
