With recent Illinois Department of Public Health and Illinois Environmental Protection Agency efforts to remove lead service lines within distribution systems – and partial lead service line replacements (PLSLR) being shown to give rise to increased lead levels – the City of Rockford is highly recommending that all customers with lead service lines replace them with an approved material in conjunction with City projects. intro (type: esriFieldTypeString, alias: DESCRIPTION OF WORK: The City shall cause the following work to be performed on the Property pursuant to the Program: A new 1" water service line will be installed through the foundation wall or through a penetration in the floor slab and be reconnected to the existing water meter. Should the existing location of the water meter not be conducive to the replacement of the service line, the water meter shall be relocated within the structure to a point pre-determined prior to construction and agreed to by the Owner. Any interior plumbing work required to relocate the water meter shall be paid for by the City. In consideration of the Owner's voluntary participation in the Program, the City, and the Owner, agree as follows:
1. CITY EXPECTATIONS: The City agrees, subject to compliance by Owner, that after any construction work done on and to the Property, that it will restore the ground surface thereof to substantially its prior condition, to the extent and within a timeframe that is practicable. City will repair and/or replace any fencing damaged or demolished as a result of any construction work or activity on the Property in connection with the Program. The City may provide for a contractor to perform some, or all of the work performed at the Property in connection with the Program.
A. WARRANTY: City hereby covenants and agrees that after any construction work done on and to the Property, that it will restore the ground surface thereof to substantially its prior condition, to the extent and within a timeframe that is practicable and will repair and/or replace any fencing damaged or demolished as a result of any construction work or activity on the Property in connection with the Program. No other warranty is provided other than as specifically enumerated in this section.
B. 1-YEAR WATER SERVICE REPAIR GUARANTEE: City hereby covenants and agrees that after the new water service line is installed to the Property, that it will provide a 1-year repair guarantee for any failure of the pipe or joints installed as part of this contract. It shall be the responsibility of the Owner to notify the City within 24 hours of plumbing clogs, low water pressure, water pooling or any other related problems are discovered with the newly installed water service line. After 1-year has passed since the date of the service installation, any repairs to the installed water service line between the curbstop valve and the water meter shall be the full responsibility of the Owner. All materials and items installed as part of this agreement will become the property of the homeowner and all future maintenance that either falls outside of the repair guarantee or after 1 calendar year has passed will become the homeowner's responsibility.
2. OWNER EXPECTATIONS: Owner acknowledges and agrees that the City is not the contractor for any services rendered through this Program, that any contractor employed is not an employee or agent of the City. Owner also acknowledges that grassed areas disturbed will be re-seeded as part of this project, and that maintenance (including mowing and watering) of the newly installed seed and corresponding grass growth is the responsibility of the Owner. Owner shall keep the performed improvements in place and may not alter, change, disconnect, or otherwise tamper with the improvements without the express, written consent and approval from the City of Rockford.
A. RELEASE: To the fullest extent permitted by law, Owner hereby releases and promises to hold
harmless the City of Rockford, its officials and employees, from claims, proceedings, penalties, fines, costs or expenses of whatsoever kind or character (including reasonable attorneys' fees and expenses), arising out of, or related in any manner to the Owner's participation in the Program, including injuries or death to persons or damage to property directly or indirectly arising out of the Program. The Owner shall not indemnify the City of Rockford for the City of Rockford's own negligence.
B. TEMPORARY CONSTRUCTION EASEMENT: Owner grants the City and contractor a Temporary Construction Easement on, over and under the Property for the purpose of surveying, staking and otherwise using such Property in order for contractor to replace the water service line on the Property from the residence located thereon to the meter well together with other site improvements required in connection therewith. The Temporary Construction Easement granted shall terminate upon completion of work undertaken through this Program.
3. FINAL AGREEMENT: This agreement represents the full and complete terms for participating in the Program. No oral agreement, guaranty, promise, condition, representation, or warranty, nor any oral modification hereof shall be binding. All prior conversations, agreements or representation related to the Program or to the water service line repair are fully integrated to this Contract.
4. NOTICE: All communication to the City shall be in writing, and delivered to the City of Rockford Water
