Description: Parcels containing “protected land uses” that require a minimum separation from marijuana establishments as outlined in ordinance AO 2016-3(S), As Amended, which was adopted on February 23, 2016. The ordinance specifies three distances of minimum separation depending on land use and community location: 100-ft, 500-ft, or 1,000-ft.
For the Eagle River - Chugiak area, this distance is measured between the lot line of the proposed marijuana facility and the lot line of the protected land use "as the crow flies" (a buffer). For the rest of the Municipality, this distance is measured between the front entrance to the proposed marijuana establishment and the nearest lot line of the protected land use by the "shortest practicable pedestrian route". This shall be measured in accordance with the Assembly’s intent as expressed in AIM 150-2016, As Amended.
